§ 58-72. General conditions.

  • (a)

    Applicability. This article applies to the incorporated and unincorporated areas of the county.

    (b)

    Compliance. No person shall install, repair, add to or perform work on a POWTS except as permitted by this article. The owner of the property on which the system is located and the company or individual doing the work are both responsible for compliance with this article.

    (c)

    Abandoned systems. POWTS that have not been used for one year or longer shall be considered abandoned. In order to be used again, the abandoned system must comply with Comm 83.03 Wis. Admin. Code. In some cases, this will require replacement of the system with a more appropriate system.

    (d)

    Privies. Vault or pit privies are prohibited, except in public and private parks and campgrounds. Self-contained non-plumbing sanitation devices may be allowed in cases where adequate plumbing facilities are also provided. See Comm 91 for alternative toilets.

    (e)

    Interpretation. The provisions of this article shall be interpreted as minimum standards, shall be construed in favor of the county, and shall not be interpreted as a limitation or repeal of any other powers granted by statute. Where a provision of this article is required by statute or administrative code, the provision shall be interpreted in light of the applicable statute or administrative code in effect at the time of the interpretation.

    (f)

    Uniform numbering. At the time any sanitary permit for new construction is issued, the code enforcement office shall notify the planning department so that the planning department can issue the new unit a building number under section 46-66 et seq. Both the property owner and the town shall be notified in writing of the assigned number and its location.

    (g)

    Habitable building. Any building intended for human habitation shall be provided with a POWTS.

    (h)

    Pretreatment components. Anaerobic treatment tanks (septic tanks) comprised of a single chamber, containing a filter for the reduction of solids within the chamber, are prohibited. The purpose of this requirement is to prevent the likelihood of human health hazards and to extend the life of the dispersal component.
