§ 44-202. Highway setbacks.

    (1)

    All state and federal highways are designated as class A highways. The setback from a class A highway shall be 110 feet from the centerline of the highway or 50 feet from the right-of-way line, whichever is greater.

    (2)

    All county trunk roads are hereby designated as class B highways. The setback from a class B highway shall be 75 feet from the centerline of the highway or 42 feet from the right-of-way line, whichever is greater.

    (b)

    Reduced highway setbacks. A setback from a state, federal or county highway may be reduced if where there is at least one similar structure on either side of the applicant's lot, each within 250 feet of the proposed site, that is built to less than the required setback. In such case, the setback shall be the average of the setback of the nearest similar structure on each side of the proposed site, on the same side of the road; or, if there is an existing similar structure on only one side, the setback shall be the average of the similar structure and the required setback.
