§ 44-83. Permitted uses.

    (a)

    The following uses are permitted in the recreational-residential district:

    (1)

    Any use permitted under article III.

    (2)

    Year round single-family and two-family dwellings for owner occupancy, rent or lease.

    (3)

    Seasonal single-family and two-family dwellings for owner occupancy, rent or lease.

    (4)

    No structure may be constructed within 20 feet of a wetland or exceed a height of 35 feet.

    (5)

    There shall be only one habitable/principal structure per lot or parcel except for planned unit developments.

    (6)

    Garages, sheds, storage buildings and boathouses, provided that:

    a.

    No such structure exceeds 864 square feet.

    b.

    Boathouses are to meet the requirements set forth in section 44-203(b)(1).

    c.

    No more than two accessory structures are permitted on the property owner's lot.

    d.

    No garage, shed, storage building, or any other accessory structure may exceed one story in height.

    e.

    Exterior side walls shall not exceed ten feet in height.

    f.

    Dormers are permitted on the roof of an accessory structure.

    g.

    Attic/storage trusses are allowed in an accessory structure.

    h.

    An accessory structure shall not be used for human habitation.

    i.

    An accessory structure no larger than 120 square feet, with sidewalls a maximum of six feet in height, may be constructed five feet from the lot line.

    j.

    No accessory structure can be of pole building type construction.

    k.

    No accessory structure can be constructed within 20 feet of a wetland.

    l.

    Accessory structures shall have a roof pitch not to exceed 4/12, but may match the roof pitch on the existing principle structure on the same lot.

    (b)

    Oversized accessory structure. An oversized accessory structure is greater than 864 square feet in area. In lieu of constructing or having two accessory structures on a lot, one oversized accessory structure may be permitted provided it meets the following conditions.

    (1)

    The structure shall not exceed 1,728 square feet in area.

    (2)

    The structure shall be at least 75 feet from the ordinary high water mark.

    a.

    Accessory structures shall have a roof pitch not to exceed 4/12, but may match the roof pitch on the existing principle structure on the same lot.

    (3)

    The structure shall be a single story.

    (4)

    The structure shall be the only accessory structure on the lot.

    (5)

    All other setback requirements shall be met.

    (6)

    The sidewall shall not exceed ten feet in height.

    (7)

    The structure shall not be used for human habitation.

    (8)

    The structure cannot be of pole building type construction.

    (9)

    No accessory structure can be constructed within 20 feet of a wetland.
