§ 27-114. Appeals.

  • (1)

    Board of adjustment. The Fond du Lac County Board of Adjustment shall act as the review and appeal authority for any order, requirement, decision or determination by the administering authority under this chapter. The rules, procedures, duties and powers of the Fond du Lac County Board of Adjustment shall be as provided in the County Code and the provisions of Wis. Stats. § 59.694, shall apply to any review or appeal under this chapter. Applicants must complete the board of adjustment application and pay the approved fee currently set at $500.00. The board of adjustment:

    (a)

    Shall hear and decide appeals where it is alleged that there is error in any order, decision or determination made by the administering authority in administering this article except for cease and desist orders obtained under section 27-113.

    (b)

    Upon appeal, may authorize variances from the provisions of this article which are not contrary to the public interest and where owing to special conditions a literal enforcement of the provisions of the ordinance will result in unnecessary hardship; and

    (c)

    Shall use the rules, procedures, duties and powers authorized by statute in hearing and deciding appeals and authorizing variances.

    (2)

    Who may appeal. Appeals to the board of adjustments may be taken by any aggrieved person or by an officer, department, board, or bureau of Fond du Lac County affected by any decision of the Fond du Lac County Land and Water Conservation Department.
